On August 1, 2014, Cecil Floyd won a defense verdict following a jury trial in Supreme Court, Bronx County in the case of Cherry v. Wilson, Index No. 307640/2009. The plaintiff alleged that she sustained a torn meniscus in her right knee requiring surgery, and traumatic subacromial impingement in her right shoulder requiring a future surgery. Mr. Floyd successfully argued that the plaintiff’s injuries were not causally related to the accident, and that she did not suffer a “serious injury” as defined by Insurance Law 5102(d). The jury returned a unanimous defense verdict.
