Cecil Floyd Wins Defense Verdict In Kings County

On January 20, 2016, Cecil Floyd won a defense verdict in Supreme Court, Kings County in Shah v. Rahman, Index No. 15370/2012. The plaintiff had prevailed on liability via summary judgment in a rear-end automobile accident, and claimed that he sustained herniated discs requiring a two-level cervical discectomy and fusion surgery. Mr. Floyd argued that the plaintiff’s injuries were not causally related to the accident, and did not qualify as a “serious injury” within the meaning of Insurance Law section 5102(d). The jury returned a unanimous verdict finding that the injuries did not qualify as a “serious injury.”
