David Gould Wins Defense Verdict In Dutchess County

On September 15, 2014, David Gould won a defense verdict in Kimble v. Floyd, Index No. 5489/2012 (Supreme Court, Dutchess County). The pedestrian plaintiff claimed that he was struck on her right arm by the driver’s side mirror of the defendant’s vehicle. The plaintiff alleged that Che sustained a torn rotator cuff to his dominant right shoulder requiring a surgical repair, and carpal tunnel syndrome in his right wrist. Mr. Gould argued that the plaintiff’s injuries were pre-existing and not causally related to the accident. The jury returned a defense verdict finding that the plaintiff’s injuries were not causally related to the accident.
