David Gould Wins Defense Verdict In Queens County

On January 19, 2017, David Gould won a defense verdict in the Supreme Court, Queens County in Singh v. Babaloolal, Index No. 709872/14. The plaintiff, a self-employed home improvement contractor, was stopped in traffic when his van was struck from behind by the defendant’s car. The plaintiff argued that he sustained a meniscal tear to his right knee, a fibrocartilage tear to his right wrist and a rotator cuff tear to his right shoulder when these parts of his body struck a makeshift tool box that was bolted to the floor of the van. Mr. Gould argued that these disputed tears could not have been caused by such a minor contact. After 45 minutes of deliberations, the jury rendered a unanimous defense verdict finding that the plaintiff did not sustain a “serious injury” within the meaning of Insurance Law section 5102(d).
